Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Chirpie platform, including the website at chirpie.ai, API, CLI, MCP server, and SDK (collectively, the "Service"), operated by Fireflo LLC ("we", "our", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials and API keys.
  • You must be at least 13 years old to use the Service.
  • One person or entity may not maintain more than one free account.

2. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Violate the terms of service of any connected social media platform (e.g., X/Twitter)
  • Post spam, misleading content, or content designed to manipulate platform algorithms
  • Impersonate other individuals or entities
  • Distribute malware, phishing content, or harmful links
  • Harass, threaten, or incite violence against any individual or group
  • Circumvent rate limits, usage quotas, or security measures
  • Resell or redistribute the Service without written authorization

3. API Keys and Access

  • API keys are confidential and must not be shared publicly or embedded in client-side code.
  • You are responsible for all activity that occurs under your API keys.
  • We may revoke API keys that are compromised or used in violation of these Terms.
  • API keys must not be used to benchmark or reverse-engineer the Service.

4. Subscriptions and Billing

  • Paid plans are billed monthly in advance via Stripe.
  • Overage charges ($0.005/post over your plan limit) are billed at the end of the billing cycle.
  • You may upgrade, downgrade, or cancel your subscription at any time.
  • Downgrades take effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis; contact support@chirpie.ai.
  • We reserve the right to change pricing with 30 days' notice.

5. Content Ownership

  • You retain ownership of all content you create and post through the Service.
  • You grant us a limited license to store, process, and transmit your content as necessary to provide the Service.
  • We do not claim ownership of your posts, threads, or other content.
  • You are solely responsible for the content you post through the Service.

6. Third-Party Platforms

The Service integrates with third-party platforms (currently X/Twitter). Your use of these platforms is subject to their respective terms of service. We are not responsible for:

  • Content removals or account suspensions by third-party platforms
  • Changes to third-party APIs that may affect the Service
  • Data practices of third-party platforms

7. Service Availability

  • We strive for high availability but do not guarantee uninterrupted service.
  • We may perform scheduled maintenance with reasonable notice.
  • We are not liable for downtime caused by third-party platform outages.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIREFLO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

  • You may delete your account at any time.
  • We may suspend or terminate your account for violation of these Terms with notice when possible.
  • Upon termination, your right to use the Service ceases immediately.
  • We will retain your data for 30 days after termination to allow for data export, then delete it.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions.
